Disability Terms and Definitions

Impairment-Related Work Expenses (IRWE) The provision that permits the exclusion from earnings of the costs of items and services which are needed in order for a disabled individual to work, which are paid for by the individual, and which are necessarily incurred by that individual because of a physical or mental impairment. AEA acquired eleptiform aphasia (Landau-Kleffner syndrome) Substantial Gainful Activity (SGA) The level of work activity used to establish disability. A finding of disability requires that a person be unable to engage in SGA. Continuation of Medicare Coverage (SSDI) You can receive at least 93 consecutive months of hospital and medical insurance after the trial work period. This provision allows health insurance to continue when you go to work and are engaging in SGA. Indexing Indexing is designed to provide some protection against inflation. After the first year of disability, a disabled employee's pre-disability earnings are usually increased (or indexed) by a certain percentage on an annual basis. Optional Supplementation The payments made by States to help persons meet needs not fully covered by Federal SSI benefits. The State determines whether it will make a payment, to whom, and in what amount. Deeming The process by which the income and resources of an ineligible individual are considered to be available to a recipient when determining eligibility or payment amount. ADA Americans with Disabilities Act The ADA prohibits discrimination on the basis of disability in employment, State and local government, public accommodations, commercial facilities, transportation, and telecommunications. It also applies to the United States Congress. Auxiliary Aids and Services Devices or services that accommodate a functional limitation of a person with a communication disability. Unincurred Business Expenses Self-employment business support given to you by someone else without cost. If you are self-employed, we deduct unincurred business expenses from earnings when we determine SGA.
